Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional areas that are not covered by the standard local authority search. These include: environmental enquiries in Abberley? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any public sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do you recommend that I order a Environmental check on the property that we are buying in Abberley? Yes we including this in our quote. We would always recommend an environmental search on the land you intend to purchase which is available from a number of search providers including Groundsure. The environmental enquiry results provide details of present and past environmental risks together with a assessment from an environmental consultant confirming whether or not the area, based upon the information revealed by the search, could be designated contaminated land by the Local Authority.

What is a water authority search ? A a CON29DW confirms to a new interested party that the property they are buying is connected to the mains water supply and mains drainage. This is particularly significant in parts of Abberley which are rural as there may be a a private drainage system.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

Always check what you are acquiring? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a client makes is not checking the plan properly. It is a good idea to visit the land parcel to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often home buyers mistakenly think that a piece of land at the side or rear of the home is theirs, only to find out that the legal title to the property doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all bills required to upkeep the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Abberley some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Abberley

Are you able to deal with a mortgage with First Direct in Abberley? Yes we are on the mortgage Panel for this lender.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Abberley.

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Government is an real person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main home. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional fees can we anticipate? We cannot give you all the costs up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing information packs often in a form called LPE1. The charge for this varies from organisation to organisation broadly it is approximately £200-300 but is can be higher in rare cases. Second, the lease usually contains a agreement for the selling to pay a payment to the management company based on a % of the sale price which is sometimes 2% although other formula may be used. The lease will need to be checked carefully.
