Searches on my Conveyancing Quote

Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they order when they are purchasing home and do not necessarily have to conduct a search. Many such purchasers think they know what a local search LLC1 will reveal and may know about the Abbey Wood or surrounding neighbourhood however most lawyers will still counsel for one. One of the main reasons is that the Official Local Authority search is the only place to reveal liabilities to the borough and this is more commonly the case with probate properties.

Do you recommend that I obtain a Environmental check on the property that we are buying in Abbey Wood? Yes we including this in our quote. We would always recommend an environmental check on the ground you intend to purchase which is available from a number of search companies including Groundsure. The environmental enquiry results provide details of present and past environmental risks together with a report from an environmental consultant confirming whether or not the land, based upon the information revealed by the search, is likely to be designated contaminated land by the Local Authority.

What is a Drainage & Water Enquiry ? A a CON29 DW search confirms to a future buyer that the site they are buying is connected to the mains water supply and mains drainage. This is particularly important in parts of Abbey Wood which are rural as there may be a a private drainage system.

General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your house to take between eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a quote what disbursements apply to your sale and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on costs disguised as ‘disbursements’. Make sure that any quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills required to maintain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Abbey Wood some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is located and possibly also building insurance.

FAQs in Abbey Wood

Are you able to conduct a mortgage with Fleet Mortgages Limited in Abbey Wood? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Abbey Wood? Is this a concern? No because like all modern law firms we depend on technology to assist us in our office to ensure that matters are dealt with expeditiously. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Abbey Wood).

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300k and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

I have obtained probate for my mother estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal fees remain the same as our standard quote for this type of Seller.
