Searches on my Conveyancing Quote

What is included in a local authority search covering Abbots Bromley? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is situated in a smoke control zone. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

I am told that the Land Charges Enquiries in Abbots Bromley will show if the land is contaminated. Is that right? That is not right. Whilst it is correct that councils are now in the process of finding polluted ground and recording these properties on registers – this is a process which will take a number of years to finish. Needless to say any properties included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Search are likely to be incomplete.

What is a a CON29 DW search ? A a CON29 DW search confirms to a prospective interested party that the home they are purchasing is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Abbots Bromley which are not built up as there may be a a private drainage system.

General Conveyancing Tips

Remember there are commonly many related sales involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest sale.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills incurred to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Abbots Bromley some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the flat is located and possibly also building insurance.

FAQs in Abbots Bromley

Are you on the panel of Royal Bank of Scotland? Yes we act for all major lenders and many smaller lenders.

Are you able to oversee Help to Buy ISAs in Abbots Bromley? Yes we are on the panel so we can deal with Help to Buy ISAs.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or less for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300k and £500k will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty if I am buying a second home in Abbots Bromley? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a maisonette what additional disbursements can we anticipate? We cannot give you all the figures up front in our quote. The costs charged by landlords and managing agents will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is around £300 but is can be higher in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two flats.

About Abbots Bromley.

Abbots Bromley is a village and civil parish within the English county of Staffordshire, England. A notably affluent part of the county, Abbots Bromley was rated the best place to live in the Midlands by the Sunday Times in 2013 and again in 2016. The village is a regular entrant and often winner of the Staffordshire Best Kept Village Competition which takes place across the county each year. Originally organised by the Community Council of Staffordshire there is a best-kept village award for a large and small village in each of the county’s Districts and Boroughs. Whilst down the years the East Staffordshire district prize has been awarded to Abbots Bromley on a number of occasions the overall county title continues to elude. In August 2017 the village won the double honour of winning both the best kept village and community council trophy award, a double not achieved for many years. This double was repeated again in 2018. In 2019 the competition was taken on by The Community Foundation for Staffordshire and Abbots Bromley won for the third consecutive year. Through the competition Abbots Bromley maintains a healthy rivalry with nearby Yoxall, also a regular winner in the East Staffordshire section.

The village is world-renowned for its annual Horn Dance, an ancient tradition which attracts visitors from far and wide.
