Searches on my Conveyancing Quote

What is included in a local authority search covering Abbotskerswell? There are two parts to a local authority search – Local Land Charges search and CON29. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the house, whether the title is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the property is subject to a tree protection order. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

When we obtain a Environmental check on the property mentioned on the conveyancing quote for the property in Abbotskerswell what will it reveal? The search provides data of present and past pollution risks together with a report from an environmental expert confirming whether or not the property is likely to be officially names as contaminated land by the council. It may also reveal other information such as whether the property is within a flood plain area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and radon risks.

What is a a CON29DW ? A water authority search confirms to a prospective buyer that the property they are purchasing is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Abbotskerswell which are not built up as there may be a a private drainage system.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

No delays and completed very quickly. Would absolutely use again and would recommend to others. I came across this firm while researching conveyancing issues online, and they had a very informative blog. I have completed the purchase within 3 months without any issues. Mouzzam and Tricia at KER were great. Always quick to reply to my emails and processed paperwork very quickly in relation to my house purchase. Their service was very professional and I would use again. Fantastic service, professional and competent.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading buying down and have a lot of items to get rid of. You can prompt the process if it is a first time buy. You may be able to exchange and complete on the same day. However your option depend on what  others in the chain will comply with.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your transaction and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their legal fees disguised as ‘disbursements’. Make sure that any estimates you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the land for some times now although this was brought in at different times across the country. For the time period in Abbotskerswell you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Abbotskerswell

Are you on the panel of National Counties Building Society and Family Building Society ? Yes we act for all major lenders and many smaller lenders.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Abbotskerswell.

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300,000 and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty if I am buying a second home in Abbotskerswell? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional fees can we anticipate? We cannot give you all the costs up front in our estimate. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing responses often in a form called LPE1. The charge for this varies from company to company usually it is around £200 but is can be higher in rare cases. Second, the lease usually contains a mechanism for the assigning to pay a charge to the management company based on a % of the sale price which is mainly 1% although other formula may be used. The lease will need to be checked carefully.
