Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the property you are purchasing and might not show land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your council covering Abbotsley. Usually, you can search most planning applications on line by postcode or by map search).

Do you recommend that I ask for an Environmental enquiry on the property that we are buying in Abbotsley? Yes we including this in our quote. We would always recommend an environmental search on the land parcel you intend to purchase which is available from a number of suppliers including Argyll Site Solutions. The environmental enquiry results provide details of present and past environmental risks together with a report from an environmental consultant confirming whether or not the properties, based upon the information revealed by the search, could be designated contaminated land by the Local Authority.

Why is a drainage search crucial if you want to extent or alter the home in Abbotsley? One of the critical replies shows a map of any public sewer close to the property you are acquiring. This is significant because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the extension more costly.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading trading down and have a lot of items to clear. You can accelerate the process if it is your first purchase. You may be able to exchange and complete simultaneously. However your instructions depend on what  others in the chain will agree to.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a consumer makes is not checking the plan properly. It is a best to go to the property to check that what is shown on the plan agrees with what you think you’re buying on site. All too often consumers mistakenly think that a piece of land at the side or rear of the property is theirs, only to find out that the legal title to the home doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all expenses needed to sustain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Abbotsley some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

No because like all modern firms we count on technology to assist us in our firm to ensure that matters are dealt with speedily. Your proximity to our office is not significant. If you are a first time buyer what additional fees can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your solicitor are required to make certain actions to make sure release of those monies including any bonus. If you complete the online quote you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to three hundred thousand pounds. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional payments can we anticipate? We cannot give you all the figures up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing assignment packs often in a questionnaire called LPE1. The charge for this varies from company to company usually it is approximately £300 but is can be higher in extreme cases. Second, the lease usually contains a provision for the assignor to pay a payment to the landlord based on a percentage of the market value which is sometimes 2% although other formula may be used. The lease will need to be checked carefully.
