Searches on my Conveyancing Quote

What is included in a local authority search covering Abingdon? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the house, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is subject to a tree protection order. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

I am told that the Land Charges Enquiries in Abingdon will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that councils are now in the process of locating contaminated land parcels and recording these properties on registers – this is a process which will take a a long time to end. Needless to say any land listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Search are likely to be incomplete.

Apart from showing that the land in Abingdon is connected to the mains water supply and mains drainage what other information does a drainage search contain? A water authority search shows to a new buyer that the land they are buying does not need a “build over consent” because the owner has constructed an alteration over a public drain. It also shows a raft of other information such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

There is more often than not a mortgage loan to organise and it should be noted that a solicitor cannot rely on a “nod and a wink” by mortgage broker or anyone else. The conveyancing lawyer will need to have sight of your final written offer of mortgage in order that they may (i) ensure that you are getting the advance you need and ensure that you can comply with any special conditions imposed in the mortgage offer.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some time now although this was brought in at different times across the country. For the time in Abingdon you should check with your conveyancer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Abingdon

Are you on the panel of Lloyds Bank? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Abingdon? Is this a problem? No because like all modern law firms we depend on technology to assist us in our firm to ensure that matters are dealt with promptly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Abingdon).

If you are a first time buyer what additional expenses can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA KER are required to make certain procedures to facilitate release of those savings including any bonus. If you complete the online quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to three hundred thousand pounds. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette what additional costs can we anticipate? We cannot give you all the costs up front in our quote. The costs charged by landlords and managing agents will vary for providing replies often in a pro forma response called LPE1. The charge for this varies from company to company often it is approximately £2500 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple leaseholds.
