Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the land you are purchasing and might not cover land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your planning department covering Abinger Hammer. Usually, you can search most planning applications on the planning departments website by postcode or by map search).

Do you recommend that both of us ask for a Environmental search on the property that we are buying in Abinger Hammer? Yes we including this in our quote. We would always recommend an environmental search on the area you intend to purchase which is available from a number of search companies including Argyll Site Solutions. The environmental search results provide details of present and past environmental risks together with a report from an environmental consultant confirming whether or not the land parcel, based upon the information revealed by the search, is likely to be designated contaminated land by the local council.

What is a Drainage & Water Enquiry ? A drainage search confirms to a potential interested party that the house they are interested in is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Abinger Hammer which are agricultural areas as there may be a a private drainage system.

General Conveyancing Tips

How long does conveyancing take? For relatively easy sale or purchase, expect the conveyancing of your house to take on average eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a quote what disbursements apply to your sale and purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their fees disguised as ‘disbursements’. Make sure that any estimates you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually kept by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some times now although this was brought in at different times across the country. For the time in Abinger Hammer you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Abinger Hammer

Are you on the panel of Godiva Mortgages Ltd? Yes we act for all major lenders and many smaller lenders.

We note that you do not have an office in Abinger Hammer? Is this a problem? No because like all modern lawyers we depend on technology to assist us in our practice to ensure that matters are dealt with swiftly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Abinger Hammer).

What SDLT will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no SDLT. If you are paying between three hundred thousand pounds and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40k. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

I have obtained Letters of Administration for our fathers estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our legal costs remain the same as quoted for this type of Seller.
