Searches on my Conveyancing Quote

What is included in a local authority search covering Abridge? There are two parts to a local authority search – Local Land Charge Register search and CON29. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the title, whether the house is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the property is subject to a tree protection order. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

When we ask for an Environmental check on the property mentioned on the conveyancing quote for the property in Abridge what will it reveal? The search provides information of present and past contamination risks together with a statement from an environmental expert confirming whether or not the area is likely to be officially names as contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flood plain area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area with high radon readings.

Apart from showing that the property in Abridge is connected to the mains water supply and mains drainage what other results does a water authority search contain? A water authority search verifies to a future interested party that the land parcel they are interested in does not need a “build over consent” because the vendor has constructed an addition to the house over a public drain. It also shows a raft of other results such as water quality and historical evidence of internal sewer flooding.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

This firm is probably the best I’ve ever dealt with regarding house moves. Mouzzam was very helpful in dealing with queries and very proactive with dealing with requests. It’s good to have a service that contacts you straight away rather than you having to constantly chase for information and answers. Our house move was a very difficult situation brought on by the buyers but he dealt with it in an exemplary and professional manner.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the time scale in Abridge you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Abridge

Are you on the panel of Tesco Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Abridge.

If you are a first time buyer what additional disbursements can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your lawyer are required to make certain procedures to ensure release of those monies including any bonus. If you complete the online quote you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300k. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you press “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional expenses can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional costs can we anticipate? We cannot give you all the figures up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from company to company often it is approximately £200-300 but is can be more in unusual cases. Second, the lease often contains a provision for the assigning to pay a charge to the management company based on a percentage of the market value which is often 2% although other formula may be used. The lease will need to be checked carefully.
