Do I need to get a local search LLC1 if I’m a cash buyer? Cash buyers do have a choice on what they ask us to order when they are purchasing a house and do not necessarily have to conduct a search. Many such purchasers think they know what a Official Local Authority search will reveal and may know about the Accrington or surrounding neighbourhood however most conveyancing solicitors will still counsel for one. One of the main reasons is that the local search LLC1 is the only place to reveal debts to the Local Authority and this is more commonly the case with .

Is there a need environmental checks in Accrington? Statutory legislation have resulted in a clean-up system for polluted sites. The basic position is that the polluter should clean up however where that party disappears (for example because the work was done some time ago or the company has gone into insolvency the liability for clear-up costs passes to the current owner (who could be you). Even if you are purchasing an maisonette in Accrington you may find that you are liable for the cost of any clear-up through the service charge provisions of the lease.

Apart from showing that the land in Accrington is connected to the mains water supply and mains drainage what other replies does a a CON29DW contain? A Drainage & Water Enquiry verifies to a prospective purchaser that the land parcel they are purchasing does not need a “build over consent” because the seller has constructed an addition to the house close to a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading selling down and have a lot of items to get rid of. You can quicken the process if it is a first time buy. You may be able to exchange and complete simultaneously. However your desire depend on what  others in the chain will consent to.

Always check what you are buying? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a consumer makes is not checking the plan properly. It is a best to go to the property to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often consumers mistakenly think that a piece of land at the side or rear of the property is theirs, only to find out that the legal title to the property doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some time now although this was brought in at different times across the country. For the time in Accrington you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Accrington

Are you on the panel of Hinckley & Rugby Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Lifetime ISAs? Yes we deal with Lifetime ISAs in Accrington.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no SDLT. If you are paying between £300k and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a leasehold what additional costs can we anticipate? We cannot give you all the disbursements up front in our quote. The costs charged by landlords and management companies will vary for providing assignment packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation broadly it is around £200-300 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 leaseholds.
