General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading selling down and have a lot of items to clear. You can accelerate the process if it is your first buy. You may be able to exchange and complete on the same day. However your choice depend on what  others in the chain will agree to.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a quote what disbursements apply to your matter and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all outlays needed to uphold the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Achurch some houses are also leasehold. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional fees can we anticipate? We cannot give you all the costs up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is approximately £300 but is can be higher in rare cases. Second, the lease usually contains a mechanism for the assigning to pay a fee to the landlord based on a percentage of the sale price which is mainly 2% although other formula may be used. The lease will need to be checked carefully.

Achurch (formerly Asenciran sometimes referred to as Thorpe Achurch) is a village in the civil parish of Thorpe Achurch, in the East Northamptonshire district, in the county of Northamptonshire, England. Situated on a small rise above the River Nene, 5 miles South of the market town of Oundle, the population of the civil parish of Thorpe Achurch at the 2011 census was 421.
