Searches on my Conveyancing Quote

Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they get when they are purchasing a property and do not necessarily have to conduct a search. Many such consumers think they know what a Local Authority search will reveal and may know about the Acle or surrounding vicinity however most solicitors will still recommend one. One of the main reasons is that the local search LLC1 is the only place to reveal monies due to the Local Authority and this is more commonly the case with .

When we ask for a Environmental search on the property mentioned on the conveyancing quote for the property in Acle what will it reveal? The search provides data of present and past pollution risks together with a certificate from an environmental consultant confirming whether or not the land would be classified contaminated land by the local council. It may also reveal other information such as whether the property is within a flooding area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and radon risks.

What is a water authority search ? A a CON29DW confirms to a prospective buyer that the home they are interested in is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Acle which are agricultural areas as there may be a a private drainage system.

General Conveyancing Tips

How long does conveyancing take? For relatively simple sale or purchase, expect the conveyancing of your property to take approximately 2 to 3 months.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the date in Acle you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Acle

Are you able to handle a mortgage with National Counties Building Society and Family Building Society in Acle? Yes we are on the mortgage Panel for this lender.

We are aware that you do not have an office in Acle? Is this a issue? No because like all modern solicitors we depend on technology to assist us in our work to ensure that matters are dealt with expeditiously. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Acle).

If you are a first time buyer what additional expenses can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA this firm are required to make certain actions to facilitate release of those monies including any bonus. If you complete the quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300,000. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main residence within 3 years.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional expenses can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing information often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is around £200-300 but is can be more in unusual cases. Second, the lease could contains a provision for the assignor to pay a payment to the freeholder based on a % of the market value which is often 2% although other formula may be used. The lease will need to be checked carefully.

The name “Acle” means “oaks lea”, that is, a clearing in an oak forest. In Tudor times, hundreds of oaks were felled here for timber to construct Elizabeth I’s warships.
