Couldn’t recommend this company enough, not to expensive and very helpful, but I especially recommend Mouzzam Yamin who dealt with my case of buying my first property. General Conveyancing Tips

There is often mortgage finance to obtain and it should be noted that a lawyer cannot rely on a quick email by mortgage broker or anyone else. The lawyer should have sight of your official written mortgage offer in order that they may (i) be able to check that you are getting the amount you need and ensure that you can comply with any special conditions imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills incurred to sustain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Acocks Green some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Acocks Green

Are you able to conduct a mortgage with Cambridge Building Society in Acocks Green? Yes we are on the mortgage Panel for this lender.

We are aware that you do not have an office in Acocks Green? Is this a issue? No because like all modern lawyers we count on technology to assist us in our firm to ensure that matters are dealt with speedily. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Acocks Green).

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300k and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

I have obtained Letters of Administration for our fathers estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our legal fees remain the same as our standard quote for this type of Seller.
