Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the title you are purchasing and might not show land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local authority covering Admaston. Usually, you can search most planning applications on the web by postcode or by map search).

Do you recommend that both of us obtain an Environmental check on the property that we are buying in Admaston? Yes we including this in our quote. We would always recommend an environmental check on the property you intend to purchase which is available from a number of search providers including Groundsure. The environmental check results provide details of present and past environmental risks together with a report from an environmental expert confirming whether or not the area, based upon the information revealed by the search, could be officially names as contaminated land by the local council.

Apart from showing that the house in Admaston is connected to the mains water supply and mains drainage what other information does a drainage search include? A drainage search verifies to a future owner that the home they are purchasing does not need a “build over consent” because the vendor has constructed an addition to the house within three metres of a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long does conveyancing take? For relatively straightforward sale or purchase, expect the conveyancing of your property to take around eight and twelve weeks.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays incurred to maintain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Admaston some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is situated and possibly also building insurance.

FAQs in Admaston

Are you on the panel of Newcastle Building Society? Yes we act for all major lenders and many smaller lenders.

We have noticed that you do not have an office in Admaston? Is this a problem? No because like all modern law firms we rely on technology to assist us in our work to ensure that matters are dealt with swiftly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Admaston).

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Taxman is an individual who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main house. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new property before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main home within 3 years.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a leasehold what additional disbursements can we anticipate? We cannot give you all the expenses up front in our estimate. The costs charged by landlords and management companies will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation broadly it is approximately £2500 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 flats.
