Searches on my Conveyancing Quote

How long do local search LLC1 searches take? The timescale for a Official Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Local Authority searches through our search provider’s website some searches are still processed completed manually by the council. Also the search wait time can be affected by seasonal demand levels and local council staffing levels.

I think that the Con29 Search in Adwick le Street will show if the land is contaminated. Is that accurate? No. Whilst it is correct that councils are now in the process of locating contaminated property and recording these land parcels on registers – this is a process which will take a many years to complete. Needless to say any land parcels listed within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Enquiries are likely to be incomplete.

Why is a a CON29DW key if you want to extent or alter the home in Adwick le Street? One of the essential results shows information of any public sewer within the home you are buying. This is significant because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the build more expensive.

General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your home to take approximately eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your matter and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their fees disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all costs required to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Adwick le Street some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Adwick le Street

Are you able to manage a mortgage with Royal Bank of Scotland in Adwick le Street? Yes we are on the mortgage Panel for this lender.

We are aware that you do not have an office in Adwick le Street? Is this a issue? No because like all modern lawyers we rely on technology to assist us in our practice to ensure that matters are dealt with promptly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Adwick le Street).

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the the Government is an person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their home. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

I am the administrators of our family estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal costs remain the same as our standard quote for this type of Seller.
