Do I need to get a Enquiries of the local authority search if I’m a cash buyer? Cash buyers do have a choice on what they ask us to order when they are purchasing land and do not necessarily have to conduct a search. Many such purchasers think they know what a Enquiries of the local authority search will reveal and may know about the Agbrigg or surrounding locale however most solicitors will still recommend one. One of the main reasons is that the local search LLC1 is the only place to reveal liabilities to the borough and this is more commonly the case with properties where the owner has gone into a home.

Is there a need environmental checks in Agbrigg? Statutory legislation have resulted in a remediation scheme for polluted land. The basic position is that the polluter should clear-up however where that party disappears (for example because the work was done some time ago or the company has gone into liquidation the liability for remediation costs passes to the present owner (who could be you). Even if you are purchasing an leasehold in Agbrigg you may find that you are liable for the cost of any clean-up through the maintenance charge provisions of the lease.

What is a a CON29 DW search ? A drainage search confirms to a potential buyer that the house they are buying is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Agbrigg which are rural as there may be a a private drainage system.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

We had a lengthy process with our lender in relation to a re-mortgage which was a bit tedious but Mouazzam Yamin helped us to get to the end of what could have been a painful process. Grateful for the help and eventually completing which was a great moment for me! Excellent and proffesional conveyancing service received for the purchase of my property. Mouzzam Yamin and Mark Sadler were both very helpful and informative with replies to my queries. Easy to deal with and hassle free.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

There is always likely to be a mortgage to apply for and it should be noted that a conveyancing solicitor cannot rely on a oral confirmation by mortgage broker or anyone else. The conveyancing lawyer must generally have sight of your formal written mortgage offer in order that she may (i) be able to check that you are getting the advance you need and be able to check that you can comply with any special conditions imposed in the facility letter.

Always check what you are buying? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a home buyer makes is not checking the plan properly. It is a best to visit the house to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often clients mistakenly think that a piece of land at the side or rear of the property is theirs, only to later discover that the legal title to the home doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the time period in Agbrigg you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Agbrigg

Are you able to deal with a mortgage with Leeds Building Society in Agbrigg? Yes we are on the mortgage Panel for this lender.

Are you able to handle Lifetime ISAs? Yes we deal with Lifetime ISAs in Agbrigg.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or lower for a residential property will pay no Stamp Duty . If you are paying between £300k and £500k will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette what additional expenses can we anticipate? We cannot give you all the figures up front in our quote. The costs charged by landlords and management companies will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation mainly it is approximately £2500 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple flats.
