Searches on my Conveyancing Quote

Do I need to get a Enquiries of the local authority search if I’m a cash buyer? Cash buyers do have a choice on what they ask us to order when they are purchasing a house and do not necessarily have to conduct a search. Many such consumers think they know what a Local Authority search will reveal and may know about the Ailsworth or surrounding area however most conveyancers will still advise one. One of the main reasons is that the Local Authority search is the only place to reveal monies due to the borough and this is more commonly the case with properties where the owner has gone into a home.

Do we need environmental investigations in Ailsworth? Statutory rules have resulted in a clear-up scheme for polluted areas. The basic position is that the polluter should remediate however where that party is missing (for example because the work was done some time ago or the company has gone into liquidation the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an flat in Ailsworth you may find that you are liable for the cost of any remediation through the maintenance charge provisions of the lease.

Apart from showing that the land parcel in Ailsworth is connected to the mains water supply and mains drainage what other data does a water authority search show? A a CON29 DW search shows to a future buyer that the home they are interested in does not need a “build over consent” because the vendor has constructed an extension over a public drain. It also shows a raft of other replies such as water quality and historical evidence of internal sewer flooding.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

Would highly recommend Mouzzam at KER. Transaction went through very quickly and smoothly. He always responded quickly to any queries I had. I recommend this firm without any doubt. Mouzzam in particular has been extremely helpful throughout the purchase of our home and has been very easy to liaise with. They (Kenneth, Elliot and Rowe) offer a fantastic service and would definately use them again.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

How long does conveyancing take? For relatively normal sale or purchase, expect the conveyancing of your home to take approximately 2 to 3 months.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the time period in Ailsworth you should check with your conveyancer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

What SDLT will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or less for a residential property will pay no Stamp Duty . If you are paying between £300,000 and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of SDLT. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional fees can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a leasehold what additional fees can we anticipate? We cannot give you all the expenses up front in our quote. The costs charged by freeholder and managing agents will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation on average it is approximately £300 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into two flats.
