Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional areas that are not covered by the standard local authority search. These include: environmental investigations in Ainderby Steeple? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clear-up); water authority searches (which show any mains sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

I believe that the Con29 Search in Ainderby Steeple will show if the land is contaminated. Is that accurate? That is not correct. Whilst it is correct that Local Authorities are now in the process of locating polluted property and recording these land on registers – this is a process which will take a decades to deliver upon. Needless to say any ground listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Search are likely to be incomplete.

Apart from showing that the land parcel in Ainderby Steeple is connected to the mains water supply and mains drainage what other information does a a CON29DW contain? A a CON29DW illustrates to a prospective buyer that the land they are interested in does not need a “build over consent” because the seller has constructed an alteration near a public drain. It also shows a raft of other replies such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

Remember there are often several connect sales involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest sale.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a quote what disbursements apply to your purchase and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on costs disguised as ‘disbursements’. Make sure that any estimates you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all bills necessary to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Ainderby Steeple some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Ainderby Steeple

Are you on the panel of Dudley Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to conduct Help to Buy ISAs in Ainderby Steeple? Yes we are on the panel so we can deal with Help to Buy ISAs.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300k and £500k will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

I am the administrators of our family estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our legal costs remain the same as quoted for this type of Seller.
