General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading buying down and have a lot of items to clear. You can accelerate the process if it is your first purchase. You may be able to exchange and complete on the same day. However your instructions depend on what  others in the chain will allow.

Always check what you are purchasing? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a client makes is not checking the plan properly. It is a good idea to go to the site to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often buyers mistakenly think that a piece of land at the side or rear of the land is theirs,only to find out that the legal title to the home doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills required to repair the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Ainsdale some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is situated and possibly also building insurance.

These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional fees can we anticipate? We cannot give you all the costs up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing information often in a form called LPE1. The charge for this varies from organisation to organisation usually it is approximately £300 but is can be higher in rare cases. Second, the lease often contains a clause for the selling to pay a charge to the management company based on a % of the sale price which is sometimes around 1-2% although other formula may be used. The lease will need to be checked carefully.

About Ainsdale.

Ainsdale is an area of Southport in the borough of Sefton, Merseyside, England, situated three miles south of the centre of Southport. Historically part of Lancashire, at the 2001 Census it had a population of 12,723. By the time of the 2011 census, only figures for Ainsdale (ward) were available.
