What is not included in a local authority search? Note that local searches are often relevant to only the title you are purchasing and might not show land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local council covering Airfield Industrial Estate. I am told that the local Search in Airfield Industrial Estate will show if the land is contaminated. Is that accurate? That is not right. Whilst it is correct that Local Authorities are now in the process of identifying contaminated property and recording these areas on registers – this is a process which will take a number of years to finish. Needless to say any land comprised within these locations will be difficult to sell in the future. How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading selling down and have a lot of items to clear. You can speed the process if it is your first purchase. You may be able to exchange and complete on the same day. However your option depend on what  others in the chain will agree to.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your sale and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their fees disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all bills needed to upkeep the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Airfield Industrial Estate some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the landlord each year. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional fees can we anticipate? We cannot give you all the disbursements up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing responses often in a pro forma response called LPE1. The charge for this varies from company to company mainly it is approximately £200 but is can be higher in unusual cases. Second, the lease usually contains a mechanism for the outgoing to pay a payment to the management company based on a % of the market value which is often around 1-2% although other formula may be used. The lease will need to be checked carefully.
