Searches on my Conveyancing Quote

How long do Local Authority search searches take? The wait time for a Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Enquiries of the local authority search electronically some searches are still processed completed manually by the local council. Also the search timescale can be affected by seasonal demand levels and local council staffing levels.

I am told that the Land Charges Enquiries in Airton will show if the land is contaminated. Is that correct? No. Whilst it is correct that Local Authorities are now in the process of locating contaminated sites and recording these land parcels on registers – this is a process which will take a decades to deliver upon. Needless to say any areas listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Enquiries are likely to be incomplete.

Why is a a CON29 DW search important if you want to extent or alter the house in Airton? One of the fundamental results shows information of any public sewer within the land you are interested in. This is important because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the foundations more expensive.

General Conveyancing Tips

There is always likely to be a mortgage loan to organise and it should be noted that a lawyer cannot rely on a quick email by mortgage broker or anyone else. She will need to have sight of your final written offer of mortgage in order that they may (i) be sure that you are getting the money you need and be sure that you can comply with any lender’s conditions imposed in the mortgage offer.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all costs required to maintain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Airton some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is located and possibly also building insurance.

FAQs in Airton

Are you able to handle a mortgage with Tesco Bank in Airton? Yes we are on the mortgage Panel for this lender.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Airton.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Revenue is an individual who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their home. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty Land Tax if I am buying a second home in Airton? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional expenses can we anticipate? We cannot give you all the costs up front in our estimate. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing responses often in a pro forma response called LPE1. The charge for this varies from organisation to organisation often it is around £300 but is can be higher in rare cases. Second, the lease usually contains a clause for the outgoing to pay a charge to the management company based on a percentage of the sale price which is often around 1-2% although other formula may be used. The lease will need to be checked carefully.
