Searches on my Conveyancing Quote

What is included in a local authority search covering Airton? There are two parts to a local authority search – Local Land Charges search and CON29. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is public or private, proposals for new roadways, railway schemes or planning history relating to the property. The responses can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

Why do we need environmental checks in Airton? Statutory rules have resulted in a clean-up system for polluted properties. The basic position is that the polluter should pay however where that party disappears (for example because the work was done some time ago or the company has gone into a winding up the liability for clean-up costs passes to the existing owner (who could be you). Even if you are purchasing an flat in Airton you may find that you are liable for the cost of any clean-up through the maintenance charge provisions of the lease.

Apart from showing that the land parcel in Airton is connected to the mains water supply and mains drainage what other replies does a a CON29DW include? A water authority search verifies to a new owner that the property they are interested in does not need a “build over consent” because the previous owner has constructed an extension close to a public drain. It also shows a raft of other results such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

Always check what you are acquiring? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a client makes is not checking the plan properly. It is a best to visit the home to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often clients mistakenly think that a piece of land at the side or rear of the property is theirs, only to later discover that the legal title to the land parcel doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some time now although this was brought in at different times across the country. For the date in Airton you should check with your solicitor. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Airton

Are you able to oversee a mortgage with Buckinghamshire Building Society in Airton? Yes we are on the mortgage Panel for this lender.

Are you able to conduct Help to Buy ISAs in Airton? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Government is an individual who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their home. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a second home in Airton? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40k. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a flat what additional disbursements can we anticipate? We cannot give you all the expenses up front in our estimate. The costs charged by freeholder and management companies will vary for providing information often in a form called LPE1. The charge for this varies from organisation to organisation broadly it is around £2500 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into a couple leaseholds.
