What is included in a local authority search covering Alburgh? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. Remember there are frequently one or more connect transactions involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest sale.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your matter and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on costs disguised as ‘disbursements’. Make sure that any quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. If we are selling a leasehold in a retirement development what additional payments can we anticipate? We cannot give you all the costs up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing information packs often in a form called LPE1. The charge for this varies from company to company on average it is approximately £2500 but is can be more in extreme cases. Second, the lease could contains a mechanism for the assignor to pay a charge to the landlord based on a percentage of the sale price which is often 2% although other formula may be used. The lease will need to be checked carefully.
