Searches on my Conveyancing Quote

Do I need to get a Official Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing a land parcel and do not necessarily have to conduct a search. Many such buyers think they know what a Local Authority search will reveal and may know about the Albury or surrounding locale however most conveyancing solicitors will still counsel for one. One of the main reasons is that the Official Local Authority search is the only place to reveal liabilities to the Local Authority and this is more commonly the case with probate properties.

I heard that the Land Charges Searches in Albury will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that Local Authorities are now in the process of finding contaminated properties and recording these land on registers – this is a process which will take a a long time to end. Needless to say any land included within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local Search are likely to be incomplete.

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond.Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a estimate what disbursements apply to your sale and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on costs disguised as ‘disbursements’. Make sure that any estimates you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title.
