What is included in a local authority search covering Aldbourne? There are two parts to a local authority search – Local Land Charges search and CON29. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the house, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is subject to a tree protection order. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Why do we need environmental enquiries in Aldbourne? Statutory laws have resulted in a remediation system for polluted areas. The basic position is that the polluter should pay however where that party is missing (for example because the work was done some time ago or the company has gone into insolvency the liability for clean-up costs passes to the existing owner (who could be you). Even if you are purchasing an flat in Aldbourne you may find that you are liable for the cost of any clear-up through the maintenance charge provisions of the lease.

Why is a Drainage & Water Enquiry essential if you want to extent or alter the home in Aldbourne? One of the indispensable details shows the location of any public sewer nearby the home you are interested in. This is important because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the design more costly.

I recently used KER for the sale and purchase. Mouzzam especially provided an excellent service ironing out any obstacles easily and efficiently, always quick to resond to calls and e-mails. Without doubt I would use KER again.

General Conveyancing Tips

There is frequently a mortgage to arrange and it should be noted that a lawyer cannot rely on a “nod and a wink” by mortgage broker or anyone else. The Firm must generally have sight of your official written offer of mortgage in order that they may (i) verify that you are getting the money you need and be sure that you can comply with any special conditions imposed in the mortgage loan.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest law firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the time period in Aldbourne you should check with your lawyer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Aldbourne

Are you able to handle a mortgage with Hinckley & Rugby Building Society in Aldbourne? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Aldbourne? Is this a issue? No because like all modern practices we depend on technology to assist us in our firm to ensure that matters are dealt with quickly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Aldbourne).

What SDLT will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or lower for a residential property will pay no SDLT. If you are paying between £300k and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new property before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main property within 36 months.

If we are buying a leasehold what additional expenses can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

We are executors of our mother estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our expenses remain the same as our standard quote for this type of Seller.

About Aldbourne.

Aldbourne is a village and civil parish about 6 miles (10 km) north-east of Marlborough, Wiltshire, England, in a valley on the south slope of the Lambourn Downs – part of the North Wessex Downs Area of Outstanding Natural Beauty. From here an unnamed winterbourne flows south to join the River Kennet 4 miles (6 km) near Ramsbury. The 2011 Census recorded the parish population as 1,833. It includes the hamlets of Upper Upham and Woodsend and part of the hamlet of Preston, which straddles the boundary with Ramsbury. The village of Snap became deserted in the early 20th century.
