Searches on my Conveyancing Quote

What is included in a local authority search covering Aldeburgh? There are two parts to a local authority search – Local Land Charge Register search and CON29. The second part of the search – Enquiries of the local authority – supplies information relating to whether the roadway abutting the property is adopted, proposals for new road schemes, rail schemes or planning permissions relating to the land. The results can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

Do you recommend that both of us order an Environmental investigation on the property that we are buying in Aldeburgh? Yes we including this in our quote. We would always recommend an environmental check on the property you intend to purchase which is available from a number of search companies including Argyll Site Solutions. The environmental search results provide details of present and past environmental risks together with a certificate from an environmental consultant confirming whether or not the land parcel, based upon the information revealed by the search, is likely to be designated contaminated land by the Local Authority.

Apart from showing that the property in Aldeburgh is connected to the mains water supply and mains drainage what other details does a a CON29DW contain? A a CON29DW illustrates to a prospective owner that the site they are purchasing does not need a “build over consent” because the owner has constructed an addition to the house within three metres of a public drain. It also shows a raft of other data such as water quality and historical evidence of internal sewer flooding.

Would highly recommend Mouzzam at KER. Transaction went through very quickly and smoothly. He always responded quickly to any queries I had. I recommend this firm without any doubt. Mouzzam in particular has been extremely helpful throughout the purchase of our home and has been very easy to liaise with. They (Kenneth, Elliot and Rowe) offer a fantastic service and would definately use them again.

General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your house to take possibly eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a quote what disbursements apply to your purchase and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their fees disguised as ‘disbursements’. Make sure that any estimates you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the time scale in Aldeburgh you should check with your solicitor. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Aldeburgh

Are you on the panel of Lloyds Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to manage Help to Buy ISAs in Aldeburgh? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Revenue is an real person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main house. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over forty thousand pounds. If you chose “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional expenses can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a leasehold what additional costs can we anticipate? We cannot give you all the figures up front in our estimate. The costs charged by freeholder and managing agents will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from company to company mainly it is approximately £2500 but is can be higher in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 maisonettes.

About Aldeburgh.

Aldeburgh ( AWL-bər-ə) is an English town on the North Sea coast in the county of Suffolk, to the north of the River Alde. It was home to the composer Benjamin Britten and has been the centre of the international Aldeburgh Festival of arts at nearby Snape Maltings, founded by Britten in 1948. It remains an arts and literary centre, with an annual poetry festival and several food festivals and other events. As a Tudor port, Aldeburgh gained borough status in 1529 under Henry VIII. Its historic buildings include a 16th-century moot hall and a Napoleonic-era Martello Tower. Second homes make up about a third of its housing. Visitors are drawn to its Blue Flag shingle beach and fisherman huts, where fresh fish are sold daily, by Aldeburgh Yacht Club, and by its cultural offerings. Two family-run fish and chip shops are listed among the best in the country.
