Searches on my Conveyancing Quote

How long do Local Authority search searches take? The timescale for a Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches through an electronic search provider some searches are still processed administered manually by the council. Also the search timescale can be affected by seasonal demand levels and local council staffing levels.

I believe that the local authority Searches in Alderminster will show if the land is contaminated. Is that accurate? That is not correct. Whilst it is correct that Local Authorities are now in the process of locating polluted land parcels and recording these areas on registers – this is a process which will take a many years to deliver upon. Needless to say any properties included within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Search are likely to be incomplete.

Apart from showing that the house in Alderminster is connected to the mains water supply and mains drainage what other details does a drainage search include? A a CON29 DW search shows to a potential purchaser that the land parcel they are purchasing does not need a “build over consent” because the owner has constructed an alteration within three metres of a public drain. It also shows a raft of other replies such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

There is often mortgage finance to arrange and it should be noted that a conveyancer cannot rely on a “nod and a wink” by mortgage broker or anyone else. The conveyancer will need to have sight of your official written mortgage offer in order that he may (i) be able to check that you are getting the amount you need and be sure that you can comply with any lender’s conditions imposed in the mortgage loan.

Always check what you are purchasing? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a purchaser makes is not checking the plan properly. It is a best to go to the home to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often home buyers mistakenly think that a piece of land at the side or rear of the site is theirs, only to discover that the legal title to the site doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some time now although this was brought in at different times across the country. For the time scale in Alderminster you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Alderminster

Are you on the panel of Bank of Ireland? Yes we act for all major lenders and many smaller lenders.

Are you able to handle Lifetime ISAs? Yes we deal with Lifetime ISAs in Alderminster.

If you are a first time buyer what additional payments can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your conveyancer are required to make certain procedures to facilitate release of those funds including any bonus. If you complete the estimate you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300,000. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat what additional disbursements can we anticipate? We cannot give you all the expenses up front in our estimate. The costs charged by landlords and managing agents will vary for providing responses often in a pro forma response called LPE1. The charge for this varies from organisation to organisation broadly it is around £200 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into a couple flats.
