Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental searches in Aldersbrook? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do we need environmental checks in Aldersbrook? Statutory rules have resulted in a clear-up system for contaminated land. The basic position is that the polluter should pay however where that party disappears (for example because the work was done some time ago or the company has gone into insolvency the liability for clear-up costs passes to the present owner (who could be you). Even if you are purchasing an flat in Aldersbrook you may find that you are liable for the cost of any remediation through the maintenance charge provisions of the lease.

What is a Drainage & Water Enquiry ? A water authority search confirms to a new buyer that the land parcel they are buying is connected to the mains water supply and mains drainage. This is particularly important in parts of Aldersbrook which are farming areas as there may be a a private drainage system.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading trading down and have a lot of items to clear. You can accelerate the process if it is your first purchase. You may be able to exchange and complete simultaneously. However your option depend on what  others in the chain will comply with.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your sale and purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their fees disguised as ‘disbursements’. Make sure that any quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the time period in Aldersbrook you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Aldersbrook

Are you on the panel of Marsden Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to oversee Help to Buy ISAs in Aldersbrook? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The characterisation of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Government is an individual who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their home. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new property before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main residence within three years.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a leasehold what additional payments can we anticipate? We cannot give you all the expenses up front in our estimate. The costs charged by landlords and management companies will vary for providing replies often in a questionnaire called LPE1. The charge for this varies from company to company mainly it is around £200-300 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into two flats.

About Aldersbrook.

Aldersbrook Aldersbrook Estate, is an Edwardian housing estate in Wanstead east London. It is named after the medieval Manor of Aldersbrook the manor itself was named after the Alders Brook, a minor river which marks part of the boundary between the London Boroughs of Newham and Redbridge. The area and the estate now wholly fall within the London Borough of Redbridge, though historically Aldersbrook Manor has always fallen inside the parish of Little Ilford, which is in turn part of what is now the London Borough of Newham.

The 2010 Mike Leigh film Another Year used the area for locations.
