Searches on my Conveyancing Quote

What is a Local Authority Search and why is it needed in Aldgate? Whilst this is to a conveyancers and mortgage lenders an indispensable component of the home buying process to clients the need for this may be somewhat of a mystery. However the search reveals relevant|applicable|appropriate|useful information for your matter. In rare cases the replies can be used to alter your the purchase price or and may even make you withdraw from the buying.

When we order a Environmental search on the property mentioned on the conveyancing quote for the property in Aldgate what will it reveal? The search provides replies of present and past pollution risks together with a report from an environmental expert confirming whether or not the property might be officially names as contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flooding area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area where radon readings are over 100 Bq m-3.

Why is a drainage search decisive if you want to extent or alter the property in Aldgate? One of the decisive replies shows a plan of of any public sewer close to the land parcel you are purchasing. This is important because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the works cost more.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading trading down and have a lot of items to get rid of. You can accelerate the process if it is your first buy. You may be able to exchange and complete simultaneously. However your choice depend on what  others in the chain will comply with.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. For the time scale in Aldgate you should check with your conveyancer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Aldgate

Are you on the panel of West Bromwich Building Society? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Aldgate? Is this a issue? No because like all modern law firms we rely on technology to assist us in our practice to ensure that matters are dealt with speedily. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Aldgate).

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Stamp Office is an real person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main house. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional expenses can we anticipate? We cannot give you all the costs up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from organisation to organisation broadly it is approximately £200 but is can be more in unusual cases. Second, the lease often contains a clause for the assignor to pay a payment to the landlord based on a percentage of the market value which is often around 1-2% although other formula may be used. The lease will need to be checked carefully.

About Aldgate.

Aldgate () was one of the gates in the former defensive wall around the City of London. It gives its name to Aldgate High Street, the first stretch of the A11 Road which included the site of the former gate. The locality of Aldgate is focussed around the former gate and the High Street and includes part of the City and parts of the London Borough of Tower Hamlets.

There is also an Aldgate Ward of the City of London, lying inside the line of the wall (until 21st century boundary adjustments). The Ward is of ancient origin but almost entirely distinct from the locality around Aldgate High Street which is mostly outside the line of the walls.
