Searches on my Conveyancing Quote

How long do Enquiries of the local authority search searches take? The wait time for a Enquiries of the local authority search can vary significantly, from 24 hours to six weeks! Although we order all our Enquiries of the local authority search through an electronic search provider some searches are still processed managed manually by the council. Also the search timescale can be affected by seasonal demand levels and Local Authority staffing levels.

I am advised that the official local Enquiries in Aldingham will show if the land is contaminated. Is that correct? That is not correct. Whilst it is correct that Local Authorities are now in the process of finding contaminated land parcels and recording these sites on registers – this is a process which will take a an uncertain amount of time to accomplish. Needless to say any areas included within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Searches are likely to be incomplete.

Apart from showing that the land in Aldingham is connected to the mains water supply and mains drainage what other details does a water authority search contain? A Drainage & Water Enquiry illustrates to a prospective buyer that the site they are acquiring does not need a “build over consent” because the vendor has constructed an addition to the house within three metres of a public drain. It also shows a raft of other data such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading selling down and have a lot of items to clear. You can accelerate the process if it is a first time buy. You may be able to exchange and complete together. However your option depend on what  others in the chain will allow.

Always check what you are buying? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a client makes is not checking the plan properly. It is a good idea to visit the site to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often home buyers mistakenly think that a piece of land at the side or rear of the land is theirs, only to find out that the legal title to the home doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the time in Aldingham you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Aldingham

Are you on the panel of TSB Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Aldingham.

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Taxman is an individual who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their home. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a flat what additional payments can we anticipate? We cannot give you all the figures up front in our on line quote. The costs charged by freeholder and managing agents will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation mainly it is approximately £200-300 but is can be more in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 maisonettes.
