Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental investigations in Aldington? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do you recommend that both of us get a Environmental check on the property that we are buying in Aldington? Yes we including this in our quote. We would always recommend an environmental search on the area you intend to purchase which is available from a number of suppliers including Homecheck. The environmental enquiry results provide details of present and past environmental risks together with a assessment from an environmental consultant confirming whether or not the site, based upon the information revealed by the search, could be classified contaminated land by the local council.

Apart from showing that the site in Aldington is connected to the mains water supply and mains drainage what other details does a drainage search show? A Drainage & Water Enquiry verifies to a new purchaser that the house they are purchasing does not need a “build over consent” because the owner has constructed an alteration close to a public drain. It also shows a raft of other information such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long does conveyancing take? For relatively easy sale or purchase, expect the conveyancing of your house to take possibly eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a quote what disbursements apply to your matter and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on costs disguised as ‘disbursements’. Make sure that any quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all bills necessary to sustain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Aldington some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

FAQs in Aldington

Are you able to conduct a mortgage with First Direct in Aldington? Yes we are on the mortgage Panel for this lender.

Are you able to deal with Help to Buy ISAs in Aldington? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Stamp Office is an individual who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main house. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main residence within 36 months.

If we are buying a flat what additional costs can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

I have obtained Letters of Administration for our mother estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our expenses remain the same as quoted for this type of Seller.
