Searches on my Conveyancing Quote

Do I need to get a local search LLC1 if I’m a cash buyer? Cash buyers do have a choice on what they get when they are purchasing a property and do not necessarily have to conduct a search. Many such purchasers think they know what a local search LLC1 will reveal and may know about the Aldridge or surrounding area however most solicitors will still recommend one. One of the main reasons is that the Official Local Authority search is the only place to reveal indebtedness to the local council and this is more commonly the case with probate properties.

Do we need environmental searches in Aldridge? Statutory legislation have resulted in a remediation system for contaminated land parcels. The basic position is that the polluter should clear-up however where that party is missing (for example because the work was done some time ago or the company has gone into liquidation the liability for clear-up costs passes to the existing owner (who could be you). Even if you are purchasing an lease in Aldridge you may find that you are liable for the cost of any remediation through the maintenance charge provisions of the lease.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all bills needed to repair the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Aldridge some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is situated and possibly also building insurance.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional costs can we anticipate? We cannot give you all the costs up front in our estimate. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from company to company usually it is around £300 but is can be higher in rare cases. Second, the lease could contains a mechanism for the selling to pay a charge to the freeholder based on a % of the sale price which is often around 1-2% although other formula may be used. The lease will need to be checked carefully.
