Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the property you are purchasing and might not show developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local planning department covering Aldwick. Usually, you can search most planning applications on the planning departments website by postcode or by map search).

When we get a Environmental investigation on the property mentioned on the conveyancing quote for the property in Aldwick what will it reveal? The search provides information of present and past contamination risks together with a certificate from an environmental expert confirming whether or not the land parcel might be designated contaminated land by the council. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area where radon readings are over 100 Bq m-3.

Why is a water authority search important if you want to extent or alter the land parcel in Aldwick? One of the critical details shows a map of any public sewer on the land you are interested in. This is significant because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the extension more expensive.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the date in Aldwick you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Aldwick

Are you able to oversee a mortgage with Monmouthshire Building Society in Aldwick? Yes we are on the mortgage Panel for this lender.

Are you able to handle Lifetime ISAs? Yes we deal with Lifetime ISAs in Aldwick.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no SDLT. If you are paying between three hundred thousand pounds and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of SDLT. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40k. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional costs can we anticipate? We cannot give you all the figures up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing assignment packs often in a form called LPE1. The charge for this varies from organisation to organisation usually it is approximately £2500 but is can be more in extreme cases. Second, the lease often contains a provision for the selling to pay a payment to the freeholder based on a percentage of the sale price which is sometimes 1% although other formula may be used. The lease will need to be checked carefully.

About Aldwick.

Aldwick is a seaside civil parish in the Arun district of West Sussex, England, which contains part of the suburbs of Bognor Regis to the East . The parish includes the smaller settlement of Rose Green.

It had, briefly, a home of the constitutional monarch of the British Empire when King George V convalesced (with his wider family regularly visiting) at Craigweil House in 1929, before its demolition. This stay led directly to Bognor attaining the suffix ‘Regis’. The area around this has throwback relatively ornate architecture of the early 20th century and a large conservation area.

Aldwick has three churches: one Anglican dedicated to St Richard, one Roman Catholic dedicated to St Anthony of Viareggio, and the Free Church (Baptist). There are a few shops and several miles of beach.
