Whilst this is to a conveyancing lawyers and lenders an critical element of the home buying process to clients the need for this may be somewhat of a mystery. Do you recommend that both of us order an Environmental search on the property that we are buying in Aldworth? Yes we including this in our quote. We would always recommend an environmental search on the land you intend to purchase which is available from a number of search providers including Homecheck. The environmental enquiry results provide details of present and past environmental risks together with a assessment from an environmental consultant confirming whether or not the area, based upon the information revealed by the search, could be classified contaminated land by the London Borough/council.

Why is a a CON29 DW search important if you want to extent or alter the land parcel in Aldworth? One of the significant results shows a plan of of any public sewer within the home you are acquiring. General Conveyancing Tips

There is more often than not a mortgage loan to arrange and it should be noted that a lawyer cannot rely on a “nod and a wink” by mortgage broker or anyone else. The conveyancing solicitor will need to have sight of your final written mortgage offer in order that he may (i) ensure that you are getting the loan you need and be able to check that you can comply with any special conditions imposed in the mortgage loan.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all costs necessary to upkeep the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Aldworth some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Aldworth

Are you able to conduct a mortgage with First Direct in Aldworth? Yes we are on the mortgage Panel for this lender.

Are you able to handle Help to Buy ISAs in Aldworth? Yes we are on the panel so we can deal with Help to Buy ISAs.

If you are a first time buyer what additional fees can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA we are required to make certain actions to ensure release of those funds including any bonus. If you complete the estimate you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300,000. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional costs can we anticipate? We cannot give you all the expenses up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing responses often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is approximately £200-300 but is can be higher in unusual cases. Second, the lease usually contains a mechanism for the selling to pay a payment to the landlord based on a % of the sale price which is often around 1-2% although other formula may be used. The lease will need to be checked carefully.

About Aldworth.

Aldworth is a mainly farmland village and civil parish in the English county of Berkshire, near the boundary with Oxfordshire, in a rural area between Reading, Newbury and Streatley. It includes the hamlet of Westridge Green. It lies on the high ground of the Berkshire Downs, just off the B4009 road between Newbury and Streatley. The north of it is crossed by The Ridgeway, an 87-mile (140 km) pre-Roman footpath. The parish church has large medieval figures in white stone, seemingly life-size, though some knights have an unlikely height of over seven feet. The Battle of Ashdown, where King Alfred defeated the Danes in January AD 871, is said by some to have been fought near The Ridgeway and Lowbury Hill.
