Searches on my Conveyancing Quote

How long do Enquiries of the local authority search searches take? The ETA for a local search LLC1 can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches through an electronic search provider some searches are still processed handled manually by the council. Also the search timescale can be affected by seasonal demand levels and council staffing levels.

Do you recommend that I obtain a Environmental investigation on the property that we are buying in All Stretton? Yes we including this in our quote. We would always recommend an environmental search on the land parcel you intend to purchase which is available from a number of search providers including Homecheck. The environmental enquiry results provide details of present and past environmental risks together with a assessment from an environmental consultant confirming whether or not the site, based upon the information revealed by the search, would be officially names as contaminated land by the local council.

Apart from showing that the property in All Stretton is connected to the mains water supply and mains drainage what other data does a a CON29 DW search show? A a CON29DW confirms to a future owner that the land they are purchasing does not need a “build over consent” because the seller has constructed an addition to the house adjacent a public drain. It also shows a raft of other replies such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

Remember there are commonly several related purchases involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest link in the chain.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a quote what disbursements apply to your purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their fees disguised as ‘disbursements’. Make sure that any written quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some times now although this was brought in at different times across the country. For the time period in All Stretton you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in All Stretton

Are you on the panel of Cambridge Building Society? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in All Stretton? Is this a concern? No because like all modern law firms we depend on technology to assist us in our practice to ensure that matters are dealt with speedily. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes All Stretton).

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Government is an person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main residence. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional costs can we anticipate? We cannot give you all the figures up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing responses often in a pro forma response called LPE1. The charge for this varies from organisation to organisation usually it is approximately £200-300 but is can be higher in extreme cases. Second, the lease usually contains a clause for the outgoing to pay a fee to the landlord based on a % of the sale price which is mainly 1% although other formula may be used. The lease will need to be checked carefully.
