Searches on my Conveyancing Quote

What is included in a local authority search covering Allenheads? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The second part of the search – Enquiries of the local authority – supplies information relating to public highways, proposals for new roads, railway schemes or building consents relating to the title. The results can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

I heard that the Land Charges Search in Allenheads will show if the land is contaminated. Is that accurate? That is not correct. Whilst it is correct that councils are now in the process of identifying polluted properties and recording these properties on registers – this is a process which will take a an uncertain amount of time to finish. Needless to say any land named within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Searches are likely to be incomplete.

Why is a a CON29 DW search crucial if you want to extent or alter the land parcel in Allenheads? One of the significant results shows information of any public sewer close to the site you are buying. This is important because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the addition cost more.

General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your home to take approximately eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a quote what disbursements apply to your purchase and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their fees disguised as ‘disbursements’. Make sure that any estimates you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the land for some time now although this was brought in at different times across the country. For the time period in Allenheads you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

Are you on the panel of M&S Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to oversee Help to Buy ISAs in Allenheads? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Government is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main house. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty if I am buying a second home in Allenheads? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

We are administrators of our mother estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our expenses remain the same as quoted for this type of Seller.
