Searches on my Conveyancing Quote

How long do local search LLC1 searches take? The ETA for a Enquiries of the local authority search can vary significantly, from 24 hours to six weeks! Although we order all our local searches LLC1 searches via a website some searches are still processed managed manually by the Local Authority. Also the search ETA can be affected by seasonal demand levels and Local Authority staffing levels.

I think that the local Searches in Allerton will show if the land is contaminated. Is that accurate? That is not right. Whilst it is correct that councils are now in the process of locating contaminated property and recording these areas on registers – this is a process which will take a a long time to complete. Needless to say any ground included within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Search are likely to be incomplete.

Why is a a CON29 DW search critical if you want to extent or alter the house in Allerton? One of the fundamental details shows information of any public sewer adjacent the house you are interested in. This is worth knowing because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the foundations more costly.

General Conveyancing Tips

How long does conveyancing take? For relatively typical sale or purchase, expect the conveyancing of your house to take on average 2 to 3 months.

Always check what you are purchasing? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a purchaser makes is not checking the plan properly. It is a good idea to go to the house to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often consumers mistakenly think that a piece of land at the side or rear of the home is theirs, only to later discover that the legal title to the house doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all outlays required to repair the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Allerton some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Allerton

Are you able to handle a mortgage with National Counties Building Society and Family Building Society in Allerton? Yes we are on the mortgage Panel for this lender.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Allerton.

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Inland Revenue is an real person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main home. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional costs can we anticipate? We cannot give you all the expenses up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from company to company broadly it is around £200-300 but is can be more in extreme cases. Second, the lease could contains a provision for the selling to pay a charge to the management company based on a percentage of the market value which is sometimes 1% although other formula may be used. The lease will need to be checked carefully.
