Searches on my Conveyancing Quote

What is included in a local authority search covering Allington? There are two parts to a local authority search – Local Land Charges search and CON29. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the land, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is subject to a tree protection order. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

Do we need environmental enquiries in Allington? Statutory legislation have resulted in a clear-up system for contaminated properties. The basic position is that the polluter should clean up however where that party disappears (for example because the work was done some time ago or the company has gone into bankruptcy the liability for remediation costs passes to the present owner (who could be you). Even if you are purchasing an maisonette in Allington you may find that you are liable for the cost of any remediation through the maintenance charge provisions of the lease.

Why is a water authority search important if you want to extent or alter the site in Allington? One of the decisive details shows the location of any public sewer within the home you are buying. This is worth knowing because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the extension more costly.

General Conveyancing Tips

How long does conveyancing take? For relatively straightforward sale or purchase, expect the conveyancing of your house to take possibly 2 to 3 months.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a customer makes is not checking the plan properly. It is a good idea to go to the site to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often home buyers mistakenly think that a piece of land at the side or rear of the land parcel is theirs, only to later discover that the legal title to the land doesn’t include this site. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all bills needed to uphold the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Allington some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Allington

Are you on the panel of Tipton & Coseley Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Allington.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300k or less for a residential property will pay no Stamp Duty Land Tax. If you are paying between three hundred thousand pounds and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of SDLT. If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

I have obtained Letters of Administration for our parents estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal costs remain the same as our standard quote for this type of Seller.
