Searches on my Conveyancing Quote

What is included in a local authority search covering Allington? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The second part of the search – Enquiries of the local authority – supplies information relating to public highways, proposals for new major roads, rail schemes or planning history relating to the land. The replies can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

I am advised that the local Search in Allington will show if the land is contaminated. Is that correct? No. Whilst it is correct that Local Authorities are now in the process of locating polluted land parcels and recording these areas on registers – this is a process which will take a unknown period of time to deliver upon. Needless to say any ground entered within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Enquiries are likely to be incomplete.

What is a drainage search ? A Drainage & Water Enquiry confirms to a new buyer that the property they are purchasing is connected to the mains water supply and mains drainage. This is particularly important in parts of Allington which are agricultural areas as there may be a a private drainage system.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading trading down and have a lot of items to get rid of. You can speed the process if it is your first purchase. You may be able to exchange and complete on the same day. However your instructions depend on what  others in the chain will consent to.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your matter and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their legal fees disguised as ‘disbursements’. Make sure that any quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all bills incurred to sustain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Allington some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Allington

Are you on the panel of Monmouthshire Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to handle Help to Buy ISAs in Allington? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Inland Revenue is an individual who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their home. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty if I am buying a second home in Allington? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a maisonette what additional fees can we anticipate? We cannot give you all the disbursements up front in our quote. The costs charged by landlords and managing agents will vary for providing assignment packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation broadly it is approximately £200 but is can be higher in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into 2 flats.
