Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional areas that are not covered by the standard local authority search. These include: environmental enquiries in Almeley? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do you recommend that I ask for an Environmental check on the property that we are buying in Almeley? Yes we including this in our quote. We would always recommend an environmental check on the land you intend to purchase which is available from a number of suppliers including Homecheck. The environmental enquiry results provide details of present and past environmental risks together with a report from an environmental expert confirming whether or not the area, based upon the information revealed by the search, could be designated contaminated land by the local council.

Apart from showing that the property in Almeley is connected to the mains water supply and mains drainage what other data does a a CON29DW include? A water authority search shows to a future interested party that the home they are buying does not need a “build over consent” because the previous owner has constructed an extension within three metres of a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long does conveyancing take? For relatively easy sale or purchase, expect the conveyancing of your property to take on average 2 to 3 months.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your matter and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on costs disguised as ‘disbursements’. Make sure that any estimates you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the property for some period now although this was brought in at different times across the country. For the time scale in Almeley you should check with your solicitor. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Almeley

Are you on the panel of Marsden Building Society? Yes we act for all major lenders and many smaller lenders.

We are aware that you do not have an office in Almeley? Is this a issue? No because like all modern firms of lawyers we rely on technology to assist us in our office to ensure that matters are dealt with promptly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Almeley).

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no Stamp Duty . If you are paying between £300k and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of SDLT. If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional fees can we anticipate? We cannot give you all the figures up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is approximately £200-300 but is can be higher in unusual cases. Second, the lease could contains a mechanism for the outgoing to pay a fee to the management company based on a % of the market value which is sometimes 2% although other formula may be used. The lease will need to be checked carefully.
