Searches on my Conveyancing Quote

What is included in a local authority search covering Alnwick? There are two parts to a local authority search – Local Land Charge Register search and CON29. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the land, whether the property is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is subject to a tree protection order. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

I am told that the local authority Search in Alnwick will show if the land is contaminated. Is that correct? Not really. Whilst it is correct that Local Authorities are now in the process of identifying polluted land and recording these areas on registers – this is a process which will take a number of years to end. Needless to say any property named within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Searches are likely to be incomplete.

Why is a water authority search critical if you want to extent or alter the home in Alnwick? One of the fundamental results shows a map of any public sewer nearby the site you are purchasing. This is significant because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the works more costly.

General Conveyancing Tips

How long does conveyancing take? For relatively easy sale or purchase, expect the conveyancing of your house to take on average 2 to 3 months.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. For the time in Alnwick you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Alnwick

Are you on the panel of Barclays Bank plc? Yes we act for all major lenders and many smaller lenders.

We have noticed that you do not have an office in Alnwick? Is this a issue? No because like all modern firms we depend on technology to assist us in our office to ensure that matters are dealt with quickly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Alnwick).

If you are a first time buyer what additional fees can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA we are required to make certain actions to make sure release of those monies including any bonus. If you complete the quote you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300,000. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

We are administrators of my parents estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our legal costs remain the same as quoted for this type of Seller.

About Alnwick.

Alnwick ( AN-ik) is a market town in Northumberland, England, of which it is the traditional county town. The population at the 2011 Census was 8,116.

The town is on the south bank of the River Aln, 32 miles (51 km) south of Berwick-upon-Tweed and the Scottish border, 5 miles (8 km) inland from the North Sea at Alnmouth and 34 miles (55 km) north of Newcastle upon Tyne.

The town dates to about AD 600, and thrived as an agricultural centre. Alnwick Castle was the home of the most powerful medieval northern baronial family, the Earls of Northumberland. It was a staging post on the Great North Road between Edinburgh and London, and latterly has become a dormitory town for nearby Newcastle-upon-Tyne[citation needed]. The town centre has changed relatively little, but the town has seen some growth, with several housing estates covering what had been pasture, and new factory and trading estate developments along the roads to the south.
