Searches on my Conveyancing Quote

What is included in a local authority search covering Alresford? There are two parts to a local authority search – Local Land Charge Register search and CON29. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the title, whether the property is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is subject to a tree protection order. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

Do we need environmental checks in Alresford? Statutory legislation have resulted in a clean-up system for polluted land. The basic position is that the polluter should remediate however where that party cannot be found (for example because the work was done some time ago or the company has gone into liquidation the liability for clear-up costs passes to the present owner (who could be you). Even if you are purchasing an maisonette in Alresford you may find that you are liable for the cost of any clear-up through the service charge provisions of the lease.

Apart from showing that the house in Alresford is connected to the mains water supply and mains drainage what other results does a a CON29 DW search include? A a CON29DW verifies to a prospective interested party that the home they are purchasing does not need a “build over consent” because the previous owner has constructed an alteration close to a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading selling down and have a lot of items to clear. You can accelerate the process if it is your first buy. You may be able to exchange and complete together. However your instructions depend on what  others in the chain will allow.

Always check what you are buying? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a customer makes is not checking the plan properly. It is a good idea to visit the property to check that what is shown on the plan agrees with what you think you’re buying on site. All too often customers mistakenly think that a piece of land at the side or rear of the house is theirs, only to discover that the legal title to the property doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by a mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the time scale in Alresford you should check with your solicitor. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Alresford

Are you on the panel of Precise Mortgages? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Help to Buy ISAs in Alresford? Yes we are on the panel so we can deal with Help to Buy ISAs.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no Stamp Duty . If you are paying between three hundred thousand pounds and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of SDLT. If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional fees can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette what additional expenses can we anticipate? We cannot give you all the disbursements up front in our estimate. The costs charged by landlords and managing agents will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation often it is approximately £300 but is can be higher in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple flats.
