Searches on my Conveyancing Quote

Do I need to get a Enquiries of the local authority search if I’m a cash buyer? Cash buyers do have a choice on what they get when they are purchasing a land parcel and do not necessarily have to conduct a search. Many such clients think they know what a Enquiries of the local authority search will reveal and may know about the Alsager or surrounding locale however most conveyancing solicitors will still advise one. One of the main reasons is that the Local Authority search is the only place to reveal indebtedness to the local council and this is more commonly the case with .

When we obtain an Environmental investigation on the property mentioned on the conveyancing quote for the property in Alsager what will it reveal? The search provides details of present and past contamination risks together with a report from an environmental expert confirming whether or not the site could be classified contaminated land by the London Borough/council. It may also reveal other information such as whether the property is within a flooding area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and radon prone area.

Apart from showing that the site in Alsager is connected to the mains water supply and mains drainage what other results does a a CON29 DW search show? A a CON29DW verifies to a potential owner that the house they are buying does not need a “build over consent” because the seller has constructed an addition to the house near a public drain. It also shows a raft of other information such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

Remember there are often a few related purchases involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest sale.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all bills incurred to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Alsager some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is located and possibly also building insurance.

If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main property within 36 months.

If we are buying a leasehold what additional expenses can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

We have obtained probate for our fathers estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our fees remain the same as our standard quote for this type of Seller.
