Searches on my Conveyancing Quote

Do I need to get a local search LLC1 if I’m a cash buyer? Cash buyers do have a choice on what they get when they are purchasing home and do not necessarily have to conduct a search. Many such home buyers think they know what a Local Authority search will reveal and may know about the Alsager or surrounding neighbourhood however most conveyancing solicitors will still prescribe one. One of the main reasons is that the Local Authority search is the only place to reveal monies due to the council and this is more commonly the case with .

Do you recommend that I order a Environmental check on the property that we are buying in Alsager? Yes we including this in our quote. We would always recommend an environmental search on the site you intend to purchase which is available from a number of suppliers including Future Climate. The environmental enquiry results provide details of present and past environmental risks together with a report from an environmental expert confirming whether or not the land parcel, based upon the information revealed by the search, might be designated contaminated land by the council.

Why is a water authority search useful if you want to extent or alter the site in Alsager? One of the indispensable replies shows a plan of of any public sewer nearby the house you are buying. This is worth knowing because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the foundations cost more.

Completed on our first home April 2016 and these guys were brilliant. Freddie Rylah guided us through the process step by step and was always available to answer any questions and help us out. As first time buyers we were reassured at every turn and the whole thing was quick and successful! Would highly recommend.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

There is always likely to be a mortgage offer to obtain and it should be noted that a conveyancing lawyer cannot rely on a informal confirmation by mortgage broker or anyone else. The conveyancing lawyer will need to have sight of your final written offer of mortgage in order that she may (i) ensure that you are getting the amount you need and ensure that you can comply with any conditions of the mortgage offer imposed in the offer of loan.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a buyer makes is not checking the plan properly. It is a best to go to the house to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often home buyers mistakenly think that a piece of land at the side or rear of the house is theirs, only to find out that the legal title to the property doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all costs needed to upkeep the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Alsager some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is situated and possibly also building insurance.

FAQs in Alsager

Are you on the panel of Cynergy Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to oversee Lifetime ISAs? Yes we deal with Lifetime ISAs in Alsager.

What is a first time buyer? The characterisation of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Inland Revenue is an person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their home. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional fees can we anticipate? We cannot give you all the disbursements up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing replies often in a form called LPE1. The charge for this varies from organisation to organisation broadly it is approximately £200 but is can be higher in extreme cases. Second, the lease could contains a mechanism for the selling to pay a charge to the landlord based on a % of the market value which is sometimes around 1-2% although other formula may be used. The lease will need to be checked carefully.
