What is included in a local authority search covering Altrincham? There are two parts to a local authority search – LLC1 and CON29. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the house is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the property is situated in a smoke control zone. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

The search provides results of present and past contamination risks together with a assessment from an environmental consultant confirming whether or not the site could be officially names as contaminated land by the council. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and radon risks.

What is a Drainage & Water Enquiry ? A water authority search confirms to a potential interested party that the home they are acquiring is connected to the mains water supply and mains drainage. General Conveyancing Tips

There is more often than not a mortgage to apply for and it should be noted that a lawyer cannot rely on a quick email by mortgage broker or anyone else. The lawyer will need to have sight of your official written offer of mortgage in order that they may (i) ensure that you are getting the advance you need and verify that you can comply with any offer conditions imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all costs required to upkeep the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Altrincham some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Altrincham

Are you on the panel of Cambridge Building Society? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Altrincham? Is this a issue? No because like all modern lawyers we rely on technology to assist us in our office to ensure that matters are dealt with rapidly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Altrincham).

If you are a first time buyer what additional disbursements can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA this firm are required to make certain steps to facilitate release of those monies including any bonus. If you complete the online quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300,000. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional fees can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

I am the executor of our parents estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our legal fees remain the same as quoted for this type of Seller.

About Altrincham.

Altrincham ( OL-tring-əm, locally ) is a market town in Trafford, Greater Manchester, England, south of the River Mersey 8 miles (13 km) southwest of Manchester city centre, 3 miles (5 km) southwest of Sale and 10 miles (16 km) east of Warrington. At the 2011 Census, it had a population of 52,419.

Within the boundaries of the historic county of Cheshire, Altrincham was established as a market town in 1290, a time when the economy of most communities was based on agriculture rather than trade, and there is still a market in the town. Further socioeconomic development came with the extension of the Bridgewater Canal to Altrincham in 1765 and the arrival of the railway in 1849, stimulating industrial activity in the town. Outlying villages were absorbed by Altrincham’s subsequent growth, along with the grounds of Dunham Massey Hall, formerly the home of the Earl of Stamford, and now a tourist attraction with three Grade I Listed Buildings and a deer park.

Altrincham today is an affluent commuter town, partly because of its transport links. The town has a strong middle-class presence; there has been a steady increase in Altrincham’s middle classes since the 19th century. It is also home to Altrincham F.C. and three ice hockey clubs: Manchester Storm, Altrincham Aces and Trafford Tornados.
