Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the title you are purchasing and might not show developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local planning department covering Alvechurch. Usually, you can search most planning applications planning pages by postcode or by map search).

I heard that the Con29 Enquiries in Alvechurch will show if the land is contaminated. Is that right? That is not right. Whilst it is correct that Local Authorities are now in the process of identifying contaminated sites and recording these land parcels on registers – this is a process which will take a unknown period of time to accomplish. Needless to say any sites listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local Search are likely to be incomplete.

What is a a CON29DW ? A Drainage & Water Enquiry confirms to a new interested party that the land they are purchasing is connected to the mains water supply and mains drainage. This is particularly important in parts of Alvechurch which are not built up as there may be a a private drainage system.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading buying down and have a lot of items to get rid of. You can accelerate the process if it is a first time buy. You may be able to exchange and complete on the same day. However your desire depend on what  others in the chain will comply with.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a quote what disbursements apply to your matter and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills required to sustain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Alvechurch some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Alvechurch

Are you able to conduct a mortgage with Leeds Building Society in Alvechurch? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in Alvechurch? Is this a issue? No because like all modern practices we count on technology to assist us in our firm to ensure that matters are dealt with expeditiously. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Alvechurch).

If you are a first time buyer what additional disbursements can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your solicitor are required to make certain checks to ensure release of those ISAs including any bonus. If you complete the quote you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300,000. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

We are executors of our mother estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our legal fees remain the same as our standard quote for this type of Seller.
