Searches on my Conveyancing Quote

Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they get when they are purchasing a site and do not necessarily have to conduct a search. Many such purchasers think they know what a Official Local Authority search will reveal and may know about the Alverstone or surrounding neighbourhood however most conveyancing solicitors will still recommend one. One of the main reasons is that the Official Local Authority search is the only place to reveal monies due to the local council and this is more commonly the case with probate properties.

Do you recommend that we ask for a Environmental investigation on the property that we are buying in Alverstone? Yes we including this in our quote. We would always recommend an environmental search on the ground you intend to purchase which is available from a number of search providers including Homecheck. The environmental search results provide details of present and past environmental risks together with a certificate from an environmental expert confirming whether or not the site, based upon the information revealed by the search, could be designated contaminated land by the Local Authority.

What is a a CON29DW ? A drainage search confirms to a prospective owner that the property they are buying is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Alverstone which are agricultural areas as there may be a a private drainage system.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills incurred to repair the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Alverstone some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the flat is situated and possibly also building insurance.

FAQs in Alverstone

Are you able to conduct a mortgage with HSBC Bank plc in Alverstone? Yes we are on the mortgage Panel for this lender.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Alverstone.

If you are a first time buyer what additional disbursements can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your solicitor are required to make certain checks to ensure release of those monies including any bonus. If you complete the quote you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300,000. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new property before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main property within 3 years.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional costs can we anticipate? We cannot give you all the disbursements up front in our estimate. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from company to company often it is approximately £2500 but is can be more in extreme cases. Second, the lease could contains a agreement for the selling to pay a payment to the landlord based on a % of the sale price which is often around 1-2% although other formula may be used. The lease will need to be checked carefully.

About Alverstone.

Alverstone is a village 2 miles from the east coast of the Isle of Wight, near Sandown. When Richard Webster became Chief Justice of England in 1900, he chose the title Lord Alverstone because it was the title he was permitted to choose which was “closest” to Sandown, one of his favourite locales. It has ever since been the ancestral home of the Alverstones, the social wing of the Cambridge University Athletics Club, named after Webster a prominent figure in the club when a student there. Alverstone Manor is located here.

Prince Albert was instrumental in creating a ‘model’ brickworks in Alverstone in the middle of the 19th century (but that is a different ‘Alverstone’, east of Whippingham Isle of Wight, on the southern edge of QV’s Osborne Estate). There is evidence from an archaeological dig in Alverstone of a Roman military presence in the area.

The Newport Junction Railway opened a station at Alverstone in the 1870s, and the station first appeared in a public schedule in June 1876. Alverstone railway station finally closed 2 June 1956. The original wooden station was replaced with one built with earth and clinkers, with wood siding.

There are many wetlands around Alverstone. Nature lovers enjoy visiting the Alverstone Marshes.

The Alverstone Mead is a 55-acre (220,000 m2) woodland and nature reserve about 1-mile (1.6 km) from Sandown. Alverstone Mead is southeast of Alverstone, and south of the cycleway between Sandown and Newport. Since 1993 the lease is held by the Wight Nature Council. It was once part of the Lower Borthwood Farm.

Transport is provided by Wightbus route 23, running between Newport and Shanklin.
