Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the title you are purchasing and might not cover land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your planning department covering Amberley. Usually, you can search most planning applications on the web by postcode or by map search).

Do we need environmental enquiries in Amberley? Statutory legislation have resulted in a clear-up system for contaminated ground. The basic position is that the polluter should clear-up however where that party cannot be found (for example because the work was done some time ago or the company has gone into bankruptcy the liability for remediation costs passes to the existing owner (who could be you). Even if you are purchasing an flat in Amberley you may find that you are liable for the cost of any remediation through the service charge provisions of the lease.

Why is a Drainage & Water Enquiry crucial if you want to extent or alter the property in Amberley? One of the indispensable results shows a map of any public sewer adjacent the site you are acquiring. This is significant because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the extension cost more.

We used KER to carry out the conveyancing on the sale of our house. Our conveyancer, Mouzzam, was always available to answer any queries and provided excellent communications through out the process. A great service from Mouzzam from start to finish, always there when needed and replied to my emails straight away. Thanks for all your help. Derek Very helpful.

General Conveyancing Tips

Remember there are invariably many linked transactions involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest link in the chain.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a consumer makes is not checking the plan properly. It is a best to visit the property to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often clients mistakenly think that a piece of land at the side or rear of the site is theirs, only to later discover that the legal title to the home doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays required to maintain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Amberley some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

FAQs in Amberley

Are you on the panel of Newcastle Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Help to Buy ISAs in Amberley? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Government is an person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main house. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a flat what additional fees can we anticipate? We cannot give you all the figures up front in our quote. The costs charged by landlords and managing agents will vary for providing information packs often in a form called LPE1. The charge for this varies from organisation to organisation usually it is approximately £300 but is can be more in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into a couple leaseholds.
