Searches on my Conveyancing Quote

What is included in a local authority search covering Ampfield? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the property is situated in a smoke control zone. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

When we get a Environmental check on the property mentioned on the conveyancing quote for the property in Ampfield what will it reveal? The search provides details of present and past pollution risks together with a statement from an environmental expert confirming whether or not the properties might be classified contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flooding area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area where radon readings are over 100 Bq m-3.

Apart from showing that the site in Ampfield is connected to the mains water supply and mains drainage what other data does a a CON29DW include? A water authority search shows to a prospective buyer that the property they are purchasing does not need a “build over consent” because the vendor has constructed an addition to the house adjacent a public drain. It also shows a raft of other data such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your property to take on average eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a estimate what disbursements apply to your sale and purchase and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any quotes you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all costs necessary to maintain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Ampfield some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Ampfield

Are you able to conduct a mortgage with Barclays Bank plc in Ampfield? Yes we are on the mortgage Panel for this lender.

We are aware that you do not have an office in Ampfield? Is this a concern? No because like all modern lawyers we depend on technology to assist us in our firm to ensure that matters are dealt with swiftly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Ampfield).

If you are a first time buyer what additional costs can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your conveyancer are required to make certain procedures to facilitate release of those savings including any bonus. If you complete the quote you will see there is an check box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to three hundred thousand pounds. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main property within 3 years.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

I have obtained probate for our family estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our expenses remain the same as quoted for this type of Seller.
