Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental investigations in Ampney Saint Mary? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

I am advised that the Land Charges Enquiries in Ampney Saint Mary will show if the land is contaminated. Is that right? Not really. Whilst it is correct that Local Authorities are now in the process of locating polluted sites and recording these land parcels on registers – this is a process which will take a number of years to complete. Needless to say any sites entered within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Search are likely to be incomplete.

Apart from showing that the land in Ampney Saint Mary is connected to the mains water supply and mains drainage what other details does a drainage search include? A water authority search illustrates to a prospective buyer that the house they are interested in does not need a “build over consent” because the owner has constructed an extension over a public drain. It also shows a raft of other information such as water quality and historical evidence of internal sewer flooding.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

This is the second time we have used Kenneth Elliot and Rowe Solicitors the first being when we bought our property in 2017. This time we needed to remortgage and also redeem our help to buy loan. We had our case handled by Mouzzam Yamin and cannot fault the service we have received. He was patient and understanding and helped with any query we had and always replied back promptly. Thought this would be a much more stressful process considering the horror stories I have heard from people redeeming their help to buy loan but the whole process went through perfectly and on time. Thanks once again to Mouzzam and the team at KER.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest law firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some time now although this was brought in at different times across the country. For the time period in Ampney Saint Mary you should check with your solicitor. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Ampney Saint Mary

Are you able to handle a mortgage with National Counties Building Society and Family Building Society in Ampney Saint Mary? Yes we are on the mortgage Panel for this lender.

Are you able to conduct Help to Buy ISAs in Ampney Saint Mary? Yes we are on the panel so we can deal with Help to Buy ISAs.

If you are a first time buyer what additional expenses can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your solicitor are required to make certain checks to ensure release of those savings including any bonus. If you complete the estimate you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty Land Tax which will be nil up to £300k. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main property within three years.

If we are buying a flat what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a flat what additional fees can we anticipate? We cannot give you all the expenses up front in our on line quote. The costs charged by landlords and managing agents will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from company to company mainly it is around £300 but is can be more in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two maisonettes.
