Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional areas that are not covered by the standard local authority search. These include: environmental investigations in Ancaster? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any mains sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

When we get an Environmental check on the property mentioned on the conveyancing quote for the property in Ancaster what will it reveal? The search provides information of present and past contamination risks together with a assessment from an environmental consultant confirming whether or not the land parcel might be designated contaminated land by the council. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and high radon area.

Why is a a CON29 DW search critical if you want to extent or alter the site in Ancaster? One of the decisive details shows a plan of of any public sewer on the property you are acquiring. This is important because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the extension more costly.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a home buyer makes is not checking the plan properly. It is a best to visit the home to check that what is shown on the plan agrees with what you think you’re purchasing on site. All too often clients mistakenly think that a piece of land at the side or rear of the home is theirs, only to later discover that the legal title to the property doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the land for some times now although this was brought in at different times across the country. For the time scale in Ancaster you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Ancaster

Are you able to conduct a mortgage with Coventry Building Society in Ancaster? Yes we are on the mortgage Panel for this lender.

We see that you do not have an office in Ancaster? Is this a issue? No because like all modern lawyers we rely on technology to assist us in our firm to ensure that matters are dealt with rapidly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Ancaster).

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Inland Revenue is an individual who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main home. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main property within 36 months.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

We have obtained Letters of Administration for my parents estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our legal costs remain the same as quoted for this type of Seller.
